 During the investigation of the crash they learned that Levi Smith, age 26 of Astoria, had been in both the Workers and the Triangle Tavern that evening. He had been cut off at the Workers because of his intoxication and had been asked to leave because he was getting angry at other patrons. Witnesses to the crash indicated that Smith ran into the street well before the intersection or crosswalk. He did not activate the crosswalk lights, did not appear to look for traffic before entering the roadway, and was crossing the street at a diagonal. He was struck by Benjamin Gonzalez, age 18 of Naselle, who was headed home from work. Gonzalez stopped at the scene, remained there and cooperated with investigators. There was no indication that Gonzalez was impaired or that he had any opportunity to miss the collision with Smith. He did brake prior to the collision.

Smith was transported to Columbia Memorial Hospital by Medix Ambulance Service. At last report he was in stable condition. The case will be referred to the District Attorney's Office.
